Competency Issues and Will and Trust Contests and Disputes

Experience Makes the Difference

To create a valid will or trust, one must be mentally, emotionally and cognitively "competent". When beneficiaries and likely beneficiaries experience legal setbacks because a loved one was not competent when he or she created an estate document, they often have a strong case to contest the document and pursue assets and property.

At the Phoenix, Arizona, probate litigation law firm of Gorman & Jones, PLC our probate attorney team is highly experienced in litigating will and trust contests due to competency questions. Did your loved one suffer a medical problem upon completing a will or trust, including:

  • Alzheimer's?
  • Dementia or senility?
  • Blindness?
  • Heavy medication?

We can effectively handle your entire dispute. Our services will likely include:

  • Filing your petition with the court
  • Investigating your case, including obtaining medical reports, meeting with treating doctors and working our own experts
  • Working with social workers, adult protective services, court-appointed investigators and general witnesses to build your case
  • Working to identify and present a sound basis for your case and presenting it in litigation, mediation or arbitration

A Recent Case Illustrates Our Effectiveness

We recently represented the adult daughter of a 92 year-old man. They lived in separate states.

Before passing away the father met a younger friend at a church. The new friend convinced the father to convey his house to him and lend him money, resulting in a full transfer of all valuables.

Our investigation revealed that the new friend had executed a similar scheme in another state. The other victims testified, resulting in a positive legal result.
